This retired analytical chemist who knew from day one that PCR was nearly completely useless for positively identifying the presence of a virus, let alone the manifestation of disease associated with said virus, would very much love someone with training in the legal profession, especially constitutional law, to explain to me how Congress managed to pull the rabbit of “liability immunity” in *1986* and PREP out of their hat.
Regardless of the enumerated power(s) on which these provisions are based, the plain language of the 9th Amendment prohibits Congress from usurping a 10th Amendment right reserved for the people in the process of exercising their enumerated powers(s). Surely the right of the people to bring a civil suit against another private party (e.g. a vaccine manufacturer) in state court would be an uncontroversial example of such a 10th amendment right?
And then there’s the so-called Vaccine Court. Article III allows for the creation of a SCOTUS and inferior courts, but conspicuously does NOT grant that court authority to adjudicate disputes between private parties. So the vaccine court is…what? I could go on about the 7th amendment’s guarantee of a jury trial.
It would seem that the frustrations over the general public’s ignorance of the Constitution should also extend to the Congress, or am I just an erstwhile Analytical Chemist who should stay in his lane of expertise?
