Exciting News! I Am To Receive the “American Patriot of the Year” Award on March 19th

I am so pleased to report that I will be honored at the 148th Gala Annual Lincoln Dinner hosted by the Queens Village Republican Club on Sunday, March 19, 2023, which will be held at Antun’s in Queens. This Republican club is the oldest in the United States, having been founded in 1875, as noted on their website. I hope you will come and join me at this special event on March 19th from 3pm-8pm.

It is an honor and a pleasure to be the recipient of their “American Patriot of the Year” award, as they recognize my work on the successful lawsuit that I brought last year against Governor Kathy Hochul and her Department of Health for their unconstitutional “Isolation & Quarantine Procedures” regulation. That lawsuit, Borrello et al v. Hochul et al, was a historic win against absolute tyranny. In the case, my plaintiffs (Senator George Borrello, Assemblyman Chris Tague, Assemblyman [now Congressman] Mike Lawler, a citizens’ group, Uniting NYS) and I argued that the Governor and her DOH breached the sacrosanct Separation of Powers doctrine that is vital to our nation remaining a free society. The theory of our case, in short, was that the Governor (who sits in the Executive Branch of government) did not have the power to make that regulation (which conflicted with existing law, and lacked the requisite due process protections, regardless). By making that regulation, the Governor impermissibly took a power reserved for the Legislative Branch of government, and in so doing, she violated the constitution.

What did the regulation say? Without exaggeration, it was something out of a dystopian horror movie. It gave the unelected bureaucrats in the Department of Health the power to pick and choose who they wanted to “detain,” if they believed you might have had a communicable disease. They did not have to prove you were actually sick! And when I say “detain,” I mean they could have locked you in your home or forced you from your home into a facility of their choosing. The length of your stay there was purely at the government’s discretion. That’s right - no time limit, so they could have held you for days, weeks, months... There was no age restriction so the government could have forced you, your child, your grandchild, or your elderly parent into quarantine.

This illegal regulation allowed for endless possibilities of government abuse because there were no due process protections built-in to safeguard your rights. Once targeted by the DOH, you would have had no recourse whatsoever - no chance to prove that you weren’t actually infected with a disease. No chance to confront your jailers, see their supposed evidence against you or challenge their quarantine order in a court of law before getting locked up. In the true fashion of a dictatorship, the government could have told you what you could and couldn’t do whilst in quarantine. For example, bureaucrats could have decided to deprive you of your cell phone or internet access, thereby totally cutting off your communications with the outside world. They could have decided to restrict your food intake, or forced you to take certain medicines or “treatments” that the government deemed appropriate.

NYS Supreme Court Judge Ronald Ploetz noted in his decision that:

“Involuntary detention is a severe deprivation of individual liberty, far more egregious than other health safety measures, such as requiring mask wearing at certain venues. Involuntary quarantine may have far-reaching consequences such as loss of income (or employment) and isolation from family.”

On July 8, 2022, Judge Ploetz ruled that the “Isolation and Quarantine Procedures” regulation was unconstitutional and “violative of New York State law as promulgated and enacted, and therefore null, void and unenforceable as a matter of law.” He struck down the regulation as unconstitutional, and prohibited the Governor and her DOH from trying to enforce it. The Attorney General, soon thereafter, filed a Notice of Appeal, and had 6 months to appeal our win. Here in New York we had statewide elections on November 8th. Not surprisingly, no appeal was filed, until…

The first week of January, just days before their 6 month deadline was up, the Attorney General asked for an additional 2 months to appeal our victory over quarantine camps! Unfortunately, the Court granted the request, despite our strong objection. As I write this article, there are 23 days left for them to file their appeal, after which time they will be barred from appealing.

Getting back to the Lincoln Dinner gala on March 19th, it should be a fabulous event. A couple of the other honorees are women I know personally: my colleague and fellow New York attorney, Tricia Lindsay, who will receive the Medical Freedom award; and Gateway Pundit and Newsmax reporter (also former NYS Assembly candidate) Cara Castronuova, who will receive the Republican Woman of the Year award. The event includes a cocktail hour, full course dinner, open bar, Viennese table, keynote speakers, award ceremonies, music and dancing.

So very deserved, Bobbie Anne! I have been following your great efforts ever since your epic quarantine camp lawsuit win. Your unwavering dedication to freedom, justice and heart to fight against this terrifying totalitarian evil that has enveloped our country and planet is truly God’s work.
